Zenimal Terms of Service

Effective Date: April 17, 2026

Welcome to Zenimal. These Terms of Service ("Terms") govern your use of the Zenimal mobile application, physical device, website, and all related services (collectively, the "Service"). By using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

Please also review our Privacy Policy, which explains how we collect, use, and protect your information.

1. Acceptance of Terms

By creating an account, downloading the Zenimal app, pairing a Zenimal device, or otherwise accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms.

2. Description of Service

Zenimal is a meditation platform that includes:

The Zenimal App -- a companion mobile application available on iOS and Android that provides access to a curated library of meditation content, AI-generated meditation scripts, custom recording tools, and device management features.
The Zenimal Device -- a physical Bluetooth Low Energy (BLE) connected toy designed to play meditation and mindfulness audio content. The device connects to the app for content management, audio transfer, and configuration.
Content Library -- a curated collection of meditation sessions, guided practices, and related audio content available through the app and device.
AI Meditation Generation -- an optional feature that uses artificial intelligence to create personalized meditation scripts based on user input.
Studio -- a feature that allows users to create, record, and manage their own custom meditation audio.

3. Eligibility and Age Requirements

      You must be at least 13 years of age to use the Service. The Service is not directed at children under 13, and we do not knowingly permit children under 13 to create accounts or otherwise use the Service.
    

By creating an account or otherwise using the Service, you represent and warrant that you are at least 13 years old. If you are between 13 and the age of legal majority in your jurisdiction (typically 18), you may use the Service only with the involvement and consent of a parent or legal guardian, and that parent or guardian agrees to be bound by these Terms on your behalf.

The physical Zenimal device is a consumer audio product that can be enjoyed by listeners of any age. These Terms, however, govern the Zenimal app, website, and related online services, which are intended for users age 13 and older. A parent or guardian is responsible for managing the account used to sync content to a Zenimal device shared with younger household members.

If we learn that we have inadvertently collected personal information from a person under 13, we will delete that information promptly. Please contact us at privacy@zenimals.com if you believe a child under 13 has provided information to the Service.

4. Account Registration and Security

To use certain features of the Service, you must create an account. When you register, you agree to:

Provide accurate, current, and complete information.
Keep your account credentials secure and confidential.
Notify us promptly if you suspect unauthorized access to your account.
Accept responsibility for all activity that occurs under your account.

You may not share your account credentials with others or allow others to access your account. Zenimal reserves the right to suspend or terminate accounts that violate these Terms.

5. Subscriptions and Payments

Subscription Plans

Zenimal offers both free and premium access. Premium subscriptions are available in the following tiers:

Annual

Specific pricing is displayed in the app and may vary by region and platform. Zenimal reserves the right to introduce additional tiers or modify tier pricing; any such changes will apply to subscriptions purchased on or after the change date unless otherwise noted.

Free Trial

New subscribers may be eligible for a 30-day free trial of premium features. At the end of the trial period, your subscription will automatically convert to a paid subscription at the applicable rate unless you cancel before the trial ends.

Auto-Renewal

All subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You can manage your subscription and turn off auto-renewal through your device's app store settings (Apple App Store or Google Play Store) or through your web checkout account.

Payment Processing

Payments for in-app subscriptions are processed by Apple (for iOS) or Google (for Android) through their respective in-app purchase systems. Web-based subscriptions are processed through Appstle via Shopify. Zenimal does not directly handle or store your payment information for in-app purchases.

Refunds

Refund requests for in-app purchases must be directed to Apple or Google, as they control the payment processing for those transactions. Zenimal cannot issue refunds for purchases made through app stores. For web-based purchases, please contact us at hello@zenimals.com.

6. User-Generated Content

The Studio feature allows you to create custom meditation recordings and other audio content ("User Content").

Your Ownership

You retain full ownership of any User Content you create. Zenimal does not claim ownership of your recordings or custom content.

Limited License

By creating User Content through the Service, you grant Zenimal a limited, non-exclusive license to store, process, and deliver your User Content solely for the purpose of providing the Service to you (for example, syncing your recordings to your Zenimal device). We will not use your User Content for marketing, training AI models, or any purpose beyond delivering the Service unless you give us explicit permission.

Your Responsibilities

You are solely responsible for your User Content. You agree not to create content that is unlawful, harmful, threatening, abusive, or otherwise objectionable.

7. AI-Generated Content

Zenimal uses artificial intelligence to generate personalized meditation scripts. By using this feature, you understand and agree that:

Provided as-is. AI-generated meditation scripts are created algorithmically and are provided without guarantees of accuracy, completeness, or suitability for any particular purpose.
Not medical or therapeutic advice. AI-generated content is not a substitute for professional medical advice, diagnosis, treatment, or therapy. If you are experiencing a mental health crisis, please contact a qualified healthcare provider or call 988 (Suicide and Crisis Lifeline).
No guarantee of consistency. AI-generated content may vary between sessions and may not always produce the same results for the same inputs.
Crisis detection. The AI system includes safety measures designed to detect language that may indicate a crisis. If such language is detected, the system may provide appropriate resource information rather than a meditation script.

8. Acceptable Use

You agree to use the Service only for its intended purpose and in compliance with all applicable laws. You may not:

Reverse engineer, decompile, disassemble, or attempt to extract the source code of the app, device firmware, or any part of the Service.
Interfere with or disrupt the Service, its servers, or connected networks.
Attempt to gain unauthorized access to any part of the Service or other users' accounts.
Use the Service to transmit malware, spam, or other harmful content.
Use automated tools (bots, scrapers, etc.) to access or collect data from the Service.
Modify, adapt, or create derivative works from the Zenimal device or its firmware.
Redistribute, resell, or sublicense any part of the Service or its content without prior written consent from Zenimal.
Use the Service in any way that could harm minors.

9. Intellectual Property

The Service and its original content (excluding User Content) are and remain the property of Zenimal. This includes but is not limited to:

The Zenimal app and its user interface, design, and code.
The curated meditation content library.
The Zenimal device hardware design and firmware.
Zenimal trademarks, logos, and branding.
All documentation, graphics, and other materials associated with the Service.

Your subscription or purchase grants you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes. This license does not transfer any ownership rights to you.

10. Physical Device

Intended Use

The Zenimal device is a consumer electronics product designed to play meditation and mindfulness audio content. It connects to the Zenimal app via Bluetooth Low Energy (BLE) and WiFi for content management and audio transfer.

Not a Medical Device

      The Zenimal device is not a medical device. It is not intended to diagnose, treat, cure, or prevent any disease or medical condition. Zenimal makes no therapeutic claims about the device or the content it plays. The device and its content are intended for general wellness and relaxation purposes only.
    

Device Warranty

To the extent permitted by applicable law, the Zenimal device is provided "as-is." Please refer to any warranty documentation included with your device purchase for specific warranty terms. Zenimal is not responsible for damage resulting from misuse, modification, unauthorized repair, or normal wear and tear.

Firmware Updates

Zenimal may periodically release firmware updates for the device. Some updates may be required for continued compatibility with the app. We recommend keeping your device firmware current for the best experience.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, ZENIMAL DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Without limiting the foregoing, Zenimal does not warrant that:

The Service will be uninterrupted, error-free, or secure.
Any content (including AI-generated content) will be accurate, reliable, or complete.
The Service will meet your specific requirements or expectations.
Defects will be corrected in any particular timeframe.

      Not medical or therapeutic advice. Nothing in the Service -- including meditation content, AI-generated scripts, or information provided through the app -- constitutes medical advice, therapy, or treatment. Always consult a qualified healthcare provider for medical concerns.
    

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ZENIMAL AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY.

IN NO EVENT SHALL ZENIMAL'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE EXCEED THE AMOUNT YOU PAID TO ZENIMAL IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, the limitations above apply to the fullest extent permitted by law.

13. Termination

By You

You may stop using the Service at any time. To close your account, you can use the account deletion feature in the app or contact us at hello@zenimals.com. Closing your account does not automatically cancel active subscriptions -- you must cancel your subscription separately through your app store or web checkout account.

By Zenimal

Zenimal may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Reasons for termination may include, but are not limited to, violation of these Terms, abusive behavior, or legal requirements.

Effect of Termination

Upon termination, your right to use the Service ceases immediately. Zenimal may delete your account data in accordance with our Privacy Policy. Any User Content stored on your Zenimal device will remain on the device, but cloud-synced content may be removed. Provisions of these Terms that by their nature should survive termination (including limitations of liability, intellectual property, and disclaimers) will continue to apply.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the state in which Zenimal operates, without regard to conflict of law principles. Any disputes arising from or related to these Terms or the Service shall be resolved in the courts located in that state, and you consent to the personal jurisdiction of those courts.

15. Changes to Terms

Zenimal reserves the right to modify these Terms at any time. When we make changes, we will update the "Effective Date" at the top of this page and notify you through the app or by email. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms. If you do not agree to the updated Terms, you should stop using the Service.

For material changes (such as changes to subscription terms, liability limitations, or data practices), we will provide at least 30 days' notice before the changes take effect.
